Terms of Participation

Thank you for choosing to participate in Citizen Solutions™.

This is our Terms of Participation (our “Terms”), which describes the terms, conditions and rules applicable to each individual (“Participant”) who chooses to participate in the Citizen Solutions™ program (the “Program”) of the Builders Network, Inc. (“Builders”), by sharing with us their Submission (as defined below). In these Terms, Builders is sometimes referred to simply as “we,” “our”, or “us.” These Terms form a legally binding agreement between Builders and each Participant.

By initiating a conversation (via a call or text) with Ima™ (as defined below) or by submitting the web form described below, Participant confirms their participation in the Program and agrees to these Terms, including, the rules of participation in the Program as stated below (“Program Rules”) and the grant of rights, releases and waivers, as stated below, in exchange for the opportunity to participate in the Program.

Program Overview

  1. The purpose of this Program is to engage Texans from across the state and the political spectrum in identifying shared needs and interests and developing practical, cross-partisan solutions to challenges, informed by public input collected by Builders. The Program aims to collect from residents of the State of Texas their healthcare-related personal stories, experiences, opinions, ideas and suggestions for legislative policies and other solutions (“Submissions”).
  1. Participant may provide Builders their Submissions in one of three ways: (i) by submitting a written Submission on a web-based form accessible through buildersmovement.org/ima (the “Program Site”); (ii) by communicating with an artificial intelligence-based (“AI”) voice agent that is accessible via the Program Site; or (iii) by communicating with an AI-based text conversation agent that is accessible via the Program Site. The AI-based voice and text conversation agents are known as “Ima”.
  1. Based on the Submissions, we may identify and generate common themes of concerns and potential solutions and policy proposals. We may develop such themes by conducting human and/or automated analysis of the Submissions. We may perform such automated analysis, processing and synthesis of Submissions into common themes, by using large language models (LLMs) and other AI (including generative AI) technology. The themes we generate based on the Submissions may be publicly shared for public education and feedback.
  1. We may synthesize such themes into a Blueprint for review at an in‑person solution session in Austin, Texas, December 5–7, 2025 (the “Solution Session”). Policy proposals resulting, in part, from discussion at such Solution Session may be shared publicly (including with other Participants) to inform civic dialogue and policymaking, including during future Texas legislative sessions. For avoidance of doubt, the themes and Blueprint will not identify Participant or any specific individual as the source or subject of any Submission, and any such themes and the Blueprint may only incorporate or be derived from de-identified portions of Submissions or clustered themes.
  1. Participation in this Program does not guarantee use of the Participant’s Submissions.

Participation and Conduct

  1. Participation is limited to individuals who reside in Texas and are 18 years of age or older at time of Submission. Participant hereby represents and warrants that they are residents of Texas and are 18 years of age or older at time of Submission. If requested during the Submission process, Participant shall self‑attest residence and age and provide a ZIP code. We may request Participant to provide their ZIP code and/or we may collect, process and use approximate signals (e.g., IP geolocation) to assess eligibility and representativeness. If Participant lives outside Texas, they are not eligible to participate in the Program, and may be directed to other opportunities to engage with Builders. If we determine that a Participant misrepresented eligibility or identity, we may, at our sole discretion, disqualify their Submission, and/or restrict or terminate their participation, and/or retain the Submission for safety, audit, and legal compliance purposes.
  1. Participant is encouraged to share a personal story and/or practical idea based on their own or another individual’s experience as a resident of Texas. Participant must not submit content that includes hate speech, threats, harassment, unlawful discrimination, defamation, substantially untrue statements, or other content that infringes or violates, or threatens to infringe or violate others’ rights, or includes malware or spam, or otherwise violates law or these Terms.
  1. Participant may not use automated tools, bots, or scripts to interact with Ima or send spam or unauthorized communications through the Submissions. Any such misuse may result in immediate suspension or legal action.
  1. Participant may submit only one Submission, whether through the web form, voice AI agent, or text AI agent. Builders may, at its discretion, disregard, merge, or delete duplicate or substantially similar Submissions from the same individual. Builders reserves the right to limit or block further participation if repeated or excessive Submissions are detected or if activity appears automated, coordinated, or otherwise inconsistent with fair participation.
  1. Submissions are made on a non-confidential basis. Participant should not include any information that Participant wishes to keep confidential.
  1. All views and opinions expressed by Participant are their own, and Builders bears no liability therefor, nor for any liability arising out of or in connection with the use or misuse of any Participant Materials (as defined below) or any Participant’s statements, opinions, or beliefs. Participation is voluntary, and Participant assumes all risks associated with their participation and disclosures in this Program, their use of Ima and provision of the Submissions, and our use of the Participation Materials.
  1. Builders cannot control public or political reaction to the Blueprint or to content created about or during the Program or the Solution Session. Builders is not responsible for outcomes from or reactions to the discussions at the Solution Session, public input on the Blueprint, or content created about or during the Program or the Solution Session, and shall not be liable for any damages, losses, costs, or claims against or incurred by any Participant or third parties as a result of such or any other Participant’s participation in or association with the Program.
  1. Participant shall not make any false or disparaging statements or any remarks that could reasonably be construed as disparaging or maliciously false or untrue regarding Builders or its affiliates, and its or their officers, directors, employees, consultants, partners, representatives, agents, subcontractors, sublicensees, successors and assigns (collectively, the “Builders Parties”).

Data Collection, Privacy, and AI Processing

  1. We will handle personal data consistent with our Privacy Notice, which will be linked on the Program Site. Participant should disclose only health information they are comfortable treating as non-confidential in their healthcare-related stories, experiences, opinions, and suggestions. We ask that you not include account numbers, medical record numbers, Social Security numbers, provider names, addresses, phone numbers, or third‑party personal information (collectively, “Healthcare and Personal Identifiers”) in any of the Submissions. While Ima is trained not to request any Healthcare and Personal Identifiers from Participant, Participant is solely responsible to avoid such disclosures and hereby undertakes responsibility for all information they choose to disclose.
  1. We may use third-party vendors (including cloud and analytics providers, and providers of LLMs and speech‑to‑text tools and other AI tools) to support the Program. Some processing may occur outside the State of Texas or the United States, subject to reasonable contractual and security safeguards.
  1. By continuing the conversation, Participant expressly consents to our recording, transcription, automated analysis, and moderation of Participant’s interactions with us, including Ima. If Participant does not consent, Participant must end the voice call or text with Ima immediately.
  1. We may retain Submissions and related recordings for as long as necessary to fulfill the purposes of the Program, including, without limitation, for safety review, improving the Program, compliance with legal obligations, and maintaining integrity of the Program. De-identified portions of Submissions may be used to evaluate or improve our Program and AI systems and models.

Safety Notices and Disclaimers

  1. AI systems may occasionally or inadvertently produce mistakes or reflect biases. Ima is made available “as is,” without any warranties of any kind, whether express or implied, including without limitation, warranties of accuracy, availability, fitness for particular purpose, or non-infringement.
  1. The conversations with Ima are not continuously monitored in real time. We may, at our sole discretion, moderate, filter, edit (e.g., to redact personal identifiers), decline, or remove Submissions and may suspend Participant’s participation. We may also surface mental‑health resources or end a session where safety, legal or other concerns are detected. Ima’s responses do not necessarily reflect the views of Builders and should not be relied upon as factual statements or advice.
  1. While Ima strives to be accurate and respectful, it may sometimes produce incomplete, inaccurate, or unintended responses. If Ima requests any Healthcare and Personal Identifiers or if a Participant is uncomfortable with any portion of the conversation with Ima, Participant should not provide the information requested and should end the conversation. If Participant would like to formally report a concern, they should send an email to ima@buildersmovement.org.  
  1. Participant acknowledges and understands that neither Builders nor its subcontractors or the Program are health‑care providers. The Program provides civic engagement and not medical, legal, or other professional advice. Participation in the Program does not create a physician‑patient or fiduciary relationship between Builders and Participant.
  1. The Program, including Ima, is not an emergency service and is not monitored continuously. If a Participant is in crisis or considering self‑harm, they should call 911 or call/text 988 (Suicide & Crisis Lifeline). Ima may provide automated safety messages or resources.

Intellectual Property and Rights Granted

  1. Participant grants Builders Parties a worldwide, perpetual, irrevocable, non‑exclusive, royalty‑free, sublicensable, and freely transferable license to use, reproduce, make copies of, modify, adapt, translate, create derivative works from, publish, perform, display, transmit, distribute, analyze, and otherwise exploit Submissions, in whole or in part, in any media now known or later developed, for Program purposes (including the Blueprint and related civic materials, research, public communications, marketing materials, safety, audit, and improvement of the Program, the Program Site, Ima and related activities, communications and platforms). Participant waives any moral rights in the Submissions to the extent permitted by law.
  1. Participant hereby irrevocably grants to Builders Parties, permission to collect, use, reproduce, record, transcribe, transmit, make copies of, store, process and make derivative works from Submissions, including, Participant’s voice, likeness and conversations with Ima, if applicable (collectively, “Participant Materials”)  in connection with the Program and any other use and the exploitation thereof by Builders, throughout the universe, in perpetuity, in any and all media now known or later devised.
  1. The Submissions, Blueprint and related content generated in connection with the Program and the Solution Session, including Program Site, and AI-generated summaries, transcripts, or materials derived from Submission are the property of Builders. Participant acknowledges that they have no ownership or authorship rights in such materials.
  1. The Submissions, Blueprint and related content generated during the Program and the Solution Session may be shared by Builders and/or its subcontractors, partners, and service providers across various digital platforms, including, without limitation, the Program Site, Builders’ and partners’ websites and social media channels, newsletters, presentations to Builders and partner organizations, and news articles. Builders will not share Submissions in their entirety or in a personally identifiable form across its social media channels, website, or other public communications. Any materials published publicly (including the Blueprint or related civic content) will reflect aggregated, summarized, or de-identified information only. If Builders ever wishes to feature an individual’s story, quote, or identifiable Submission in a manner that could reasonably identify the Participant, Builders will first contact that individual and obtain their express written consent before doing so.
  1. Builders shall have the unrestricted right to use and to allow others (including other Builders Parties) to use any or all of the rights granted by Participant hereunder and to license, assign or otherwise convey or dispose, the same to any third party (including any other Builders Parties).

Participant Responsibilities

  1. Participant shall indemnify and hold harmless each of the Builders Parties from any and all liability or claim in connection with the Submission and Appearance, any use thereof, or claims arising from Participant’s breach of these Terms. Participant, including their heirs and successors, hereby release the Builders Parties from and agree not to bring or support any claim or cause of action against them for any reason whatsoever, including without limitation, any claim for libel, slander, invasion of privacy or right of publicity, infringement, misappropriation or other violation of any intellectual property or other rights, arising out of the exercise of any rights Participant has granted in these Terms.
  1. Participant understands and agrees that, except as specifically stated herein, Participant shall not be entitled to any consideration, monetary or otherwise, for participating in the Program or providing the Submission, including any use thereof.
  1. Participant grants the foregoing consent and rights with the knowledge and understanding that Builders and others will incur considerable expense and/or undertake commitments in reliance thereon and that all rights granted by Participant herein are therefore irrevocable.

Enforcement and General Legal Terms

  1. We may suspend or terminate Participant’s access to Ima at any time without notice if Participant violates these Terms or engages in misuse.
  1. Participant’s participation does not create any employment, partnership, joint venture, or agency relationship with Builders.
  1. In the event of any dispute relating to these Terms, the Submission or any project or works using the Submission, Participant agrees that their remedies and those of their heirs, representatives and agents, shall be strictly limited to seeking only actual monetary damages, if any, in an action at law and Participant hereby waives all equitable relief, including any right to rescind or terminate these Terms or any rights granted herein or to interfere in any manner with the Program or use of the Submission.
  1. These Terms shall be interpreted in accordance with the laws of the State of Texas, and any and all disputes and claims arising under these Terms shall be brought before and be subject to the exclusive jurisdiction of the state and federal courts located in Travis County, Texas.
  1. These Terms, along with the Privacy Notice which is incorporated into these Terms by reference, contains the entire understanding relating to its subject matter and cannot be modified except in writing by Builders. Should any provision of these Terms be determined to be void, it shall not affect the validity of any other provision of these Terms. Builders may assign this agreement and all of its rights and obligations hereunder to any third party, and these Terms inures to the benefit of successors and assigns of Builders. Participant may not assign these Terms or any rights or obligations hereunder to any third party.
  1. Participant acknowledges that, before participating in the Program by providing a Submission, Participant has had the opportunity to read these Terms and obtain the advice of legal counsel regarding these Terms, and that Participant has either done so or freely decided not to do so. Participant confirms that Participant has not been promised anything except as specifically set forth in these Terms; and that Participant is at least 18 years old.
